    The Road Safety Act 2006

    The Road Safety Act 2006 has received Royal Assent. That does not mean that it is now in force, or that all of it will ever be activated. The government will bring it in a piece at a time.

    This is a short list of the parts of the act that are most likely to come into force. I will update this thread with dates of introduction as soon as I know what they are.

    Some existing offences will carry higher penalties.
    Use of a mobile phone while driving will carry 3 points - as from 27 Feb 2007

    Fail to ID driver under s172 will carry 6 points (currently 3) - as from 24 Sept 2007

    Child not wearing seat belt max fine £500 as from 24 Sept 2007

    DWDC max fine will go up to £5000 (currently £2500) as from 24 Sept 2007

    Second offence of using a vehicle in a dangerous condition, if within 3 years of first offence will carry 6 month MANDATORY disqualification. It will NOT be possible to plead exceptional hardship to avoid the disqualification. as from 24 Sept 2007

    Failure to stop a motor vehicle when required to do so by a police officer, max fine was £1,000, now £5,000 as from 24 Sept 2007

    Furious driving (Offences Against the Person Act 1861) which is occasionally used to prosecute bad driving in situations where the Road traffic Act does not apply (eg when not committed in a public place ) will carry points ( 3 to 9) if act comitted in a motorised vehicle. This charge also applies to horse drawn vehicles, but they do NOT attract points. as from 24 Sept 2007

    Police and VOSA will have some new powers

    Feds will have wider range of powers to deal with speeding - points range will be 2 to 6 (currently 3 to 6).

    VOSA will have wider range of powers to deal with vehicle offences - points range will be 2 to 6 (currently 3 to 6).

    Foreign licence holders will be able to accept fixed penalties BUT may need to pay deposit on the spot to ensure that the ticket is paid. Police and vehicle examiners will have the power to prohibit further use of the vehicle until the deposit (or the fixed penalty) has been paid.

    new offences

    "Speed assessment equipment detection devices" are to be banned. This will cover "any device, the purpose, or one of the purposes of which, is to detect or interfere with the operation of equipment used to assess the speed of motor vehicles. It does not include devices which use a database of camera locations together with a mapping system. The penalty for possession will be similar to that for speeding.

    Causing death while having no licence, no insurance or while disqualified- will carry 2 years custody came in to force 11/08/2008

    Keeping a vehicle without insurance, unless subject to SORN or beyond owners control ie stolen and dumped. Proposed penalty is an FP of £100

    Causing death by careless driving. Carries 5 years custody. came in to force 11/08/2008

    Courts to have new powers to (attempt) to educate drivers

    At present the drink drivers rehablitation course fee (apporx £200) must be paid in advance. Installment payments will be allowed.

    Courses similar in principle to the Drink Driver rehabilitation course will be introduced for DWDC, speeding and fail to obey traffic sign offences. The courses will be offered to drivers who have received a discretionary ban for 12 months or more. Successful completion will give a discount off the ban - probably 25%

    Drivers who are near totting for speeding and/or DWDC will be able to take a driving improvement course. Successful completion will "lose" some points. Probably 1, 2 or 3 depending on the course and how well the offender scores.

    odds and sods

    It will be necessary to give your date of birth when registering a car with the DVLA. It seems some body thinks this will help to ID drivers caught on camera.

    An extended driving test will become a requirement for those convicted of a second (or third, or fourth................) alcohol related motoring offence.

    There is new guideance with regard to careless and inconsiderate driving. The law has not changed, but the new guideance should make it easier to understand and apply.

    (2) A person is to regarded as driving without due care and attention if (and only if) the way he drives falls below what would be expected of a competent and careful driver.
    (3) In determining for the purposes of subsection (2) what would be expected of a competent and careful driver in a particular case, regard shall be had not only to the circumstances of which he could be expected to be aware but also to any circumstances shown to have been within the knowledge of the accused.
    (4) A person is to be regarded as driving without reasonable consideration for other persons only if those other persons are inconvenienced by his driving. as from 24 Sept 2007
